TL;DR: By using Galligraphy, you agree to these terms. Custom printed products are final sale (no returns except for defects). You retain rights to your designs; we use them only to fulfill your orders. You're responsible for reviewing designs before ordering. Cancel within 24 hours via your order email or tracking page. Disputes are resolved through arbitration in Colorado.

1. Agreement to Terms

By accessing or using Galligraphy ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is operated by Galligraphy Designs, LLC ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

Galligraphy provides:

A free online tool for generating Circular Gallifreyan text designs
Educational content about the Circular Gallifreyan writing system

E-commerce services for ordering custom printed products featuring user-generated designs
Digital download services for high-resolution design files (when available)

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent to make purchases. By using the Service, you represent that you meet these age requirements.

4. User Account and Conduct

4.1 Guest Checkout

Currently, purchases can be made without creating an account. You are responsible for providing accurate contact and shipping information.

4.2 Prohibited Uses

You may not use the Service to:

Generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Infringe upon intellectual property rights of others
Attempt to reverse-engineer or extract our proprietary Gallifreyan generation algorithm
Use automated tools to create excessive requests or scrape content
Impersonate any person or entity

5. Intellectual Property

Short version: You own your designs. We only use them to fulfill your orders and display them if you share publicly. Our generator algorithm and website are proprietary.

5.1 Your Designs

You retain all rights to the text you input and the designs you create using our Service. By creating designs, you grant us a limited license to:

Generate and display your designs within the Service

Process and fulfill orders for physical products featuring your designs

Display your shared designs publicly if you choose to share them

5.2 Our Intellectual Property

The Galligraphy generator algorithm, software, website design, and branding are proprietary and protected by copyright, trademark, and other intellectual property laws. You may not:

Copy, modify, or reverse-engineer our generation algorithm
Use our branding or trademarks without permission
Reproduce or distribute our educational content without attribution

5.3 Third-Party Content

Circular Gallifreyan is a fan-created writing system inspired by Doctor Who. Doctor Who and related trademarks are owned by the BBC. We are an independent fan project not affiliated with or endorsed by the BBC.

6. E-Commerce Terms

6.1 Product Orders

When you place an order for custom printed products:

You are making an offer to purchase
We reserve the right to refuse or cancel any order
Orders are fulfilled through our print-on-demand partner (Printify)
Prices are in USD unless otherwise stated
You are responsible for all applicable taxes and duties

6.2 Custom Print Policy (NO RETURNS)

Short version: Custom products can't be returned or refunded (except defects). Cancel within 24 hours via your order email or /orders page. Review your design carefully before ordering.

IMPORTANT: All printed products are custom-made with your unique design.

Due to the personalized nature of custom printed items:

We do not accept returns
We do not offer refunds except in cases of defective products or fulfillment errors
You may cancel orders yourself within 24 hours via your order confirmation email or order tracking page
Once production begins, orders cannot be cancelled
You are responsible for reviewing your design carefully before placing an order

Color Accuracy: Colors may vary slightly from your screen to the printed product due to differences in display calibration and printing processes. This is not grounds for return or refund.

6.3 Defective Products

If you receive a defective product (production error, damage, wrong item), contact us within 14 days of delivery with photo evidence. We will:

Offer a full refund to your original payment method, OR
Offer a replacement at no additional cost
You may keep the defective item (we do not require returns)

Defects covered:

Manufacturing defects or errors
Damage during production or shipping
Wrong product or variant shipped
Missing items from your order

Defects NOT covered:

Minor color variations from screen to print
Changes of mind about design or product choice
Normal wear and tear after use

6.4 Shipping

Shipping times vary by product and destination
We ship to addresses in the United States (additional countries coming soon)
You will receive tracking information via email when your order ships
We are not responsible for delays caused by shipping carriers
Shipping fees are calculated at checkout and are non-refundable

6.5 Payment

We accept major credit cards and other payment methods as displayed at checkout
Payment is processed securely through third-party payment processors
By providing payment information, you represent that you are authorized to use that payment method
Prices are subject to change, but changes do not affect already-placed orders

7. Digital Downloads (When Available)

Short version: Digital downloads are for personal use only, delivered via secure link, and non-refundable after download.

For digital download products:

Downloads are for personal use only unless commercial license is purchased
You may not resell or redistribute downloaded files
Downloads are delivered via secure link after purchase
Download links expire after a reasonable period (typically 30 days)
You are responsible for backing up downloaded files

8. Content Sharing and Social Media

When you share designs via social media:

You grant us permission to feature your shared designs in our marketing
Shared designs become publicly visible
You represent that you have the right to share any text or content in your designs
We may remove shared content that violates these Terms

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

Warranties of merchantability or fitness for a particular purpose
Warranties that the Service will be uninterrupted or error-free
Warranties regarding the accuracy or reliability of generated designs
Warranties regarding product quality beyond our stated defect policy

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for indirect, incidental, special, consequential, or punitive damages
Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim
We are not liable for issues caused by third-party services (payment processors, shipping carriers, print providers)

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Content you create or share using the Service

12. Third-Party Services

The Service integrates with third-party services including:

Printify (print-on-demand fulfillment)
Payment processors (Stripe or similar)

Analytics services (Google Analytics)
Social media platforms (for sharing)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

13. Termination

We may terminate or suspend your access to the Service at any time, with or without cause or notice, including for:

Violation of these Terms
Fraudulent or illegal activity
Abusive behavior toward our team or community

Upon termination:

Your right to use the Service ceases immediately

Already-placed orders will be fulfilled unless cancelled for cause

Provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability) will survive

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the United States and the State of Colorado, without regard to conflict of law principles.

14.2 Informal Resolution

Before filing a claim, you agree to contact us to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

14.3 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except you may assert claims in small claims court if they qualify.

14.4 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or consolidated proceeding.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign these Terms without our consent. We may assign these Terms to any successor or affiliate.

15.5 Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control.
